This website located at https://MedReviewservices.com (Website) is owned and operated by Aggarwal Pty Ltd ABN 11 132 967 438 (MedReview Services). 


By using this Website and in consideration of MedReview Services providing you with access to the Website and to the Services, you confirm that these Terms and Conditions govern: 


your access to and use of the Website; and  


your access to and use of MedReview Services's Services.  


By using the Website you accept and agree to comply with these Terms and Conditions. 


MedReview Services reserves the right to amend these Terms and Conditions from time to time. Every time you wish to use the Website, please check these Terms and Conditions to ensure you understand the terms and conditions that apply at that time.


 

1.      Definitions 

In these Terms and Conditions: 

Accredited Pharmacist 

means a registered pharmacist with appropriate skills and expertise recognised by formal accreditation to conduct medication reviews from an approved accreditation body. 

DMMR 

means a Domiciliary Medication Management Review (also known as a Home Medicines Review as provided for in the Medicare Benefits Schedule and the HMR Program Rules. 

HMR Program Rules 

means the Home Medicines Review Rules published by the Pharmacy Programs Administrator and accessible via: https://www.ppaonline.com.au/programs/medication-management-programs/home-medicines-review  

Services 

means the services provided by MedReview Services to medical practitioners, patients and Accredited Pharmacists, including: 

the acceptance and processing of referrals from medical practitioners of patients seeking a DMMR or RMMR; 

the forwarding of referrals referred to in paragraph (a) to Accredited Pharmacists; and 

the receipt of HMR Reports from Accredited Pharmacists and the forwarding of those to the referring medical practitioner.  

Participating medical practitioners  

A medical practitioner registered with the Australian Health Practitioner Regulation Agency (AHPRA) may refer a patient to MedReview Services for a DMMR or RMMR. A medical practitioner who refers, or attempts to refer, a patient to MedReview Services is deemed a Participating Practitioner. 

A reference to "you" is a reference only to Participating Practitioners. 

You acknowledge the following: 

MedReview Services is not a community pharmacy and does not employ any pharmacists accredited for the purposes of conducting DMMRs or RMMRs; 

MedReview Services acts solely as a conduit to connect Participating Practitioners with Accredited Pharmacists so that the practitioner and pharmacist can conduct a DMMR or RMMR and each respectively claim (if appropriate) a Medicare Benefit from the Commonwealth Government or payment from the Pharmacy Programs Administrator;  

MedReview Services may refer your patient to an accredited pharmacist who is not located within the same suburb or postcode as your patient and the pharmacist may seek to conduct a telehealth review where appropriate; and 

MedReview Services will not assist you claim a Medicare Benefit, nor does it make any representation or warranty about your eligibility to claim a Medicare Benefit as a consequence of using MedReview Services's services. You must ensure that each patient you refer to MedReview Services satisfies the patient eligibility criteria for a DMMR (MBS Item 900). 


MedReview Services will not charge you for referring patients but may, in its absolute discretion, refuse to accept a particular referral from you or cease accepting all referrals from you for any reason,  


MedReview Services will promptly notify you if it refuses to accept a particular referral, or all referrals, from you. 


You acknowledge that you are responsible for your patient and that a referral to MedReview Services does not alter your obligations to your patient. 


Participating pharmacists  


An Accredited Pharmacist that is registered with the Australian Health Practitioner Regulation Agency, and is not prohibited from practice, and is accredited to uertake DMMRs may receive patient referrals from MedReview Services for the purposes of conducting a medicines review. An eligible pharmacist who receives a referral of a patient from MedReview Services is deemed a Participating Pharmacist.  


A reference to "you"is a reference only to Participating Pharmacists. 


You acknowledge the following: 


MedReview Services is not a general practice and does not employ medical practitioners for the purposes of conducting DMMRs or RMMRs; 


MedReview Services acts solely as a conduit to connect medical practitioners with Participating Pharmacists so that the practitioner and pharmacist can conduct a DMMR or RMMR and each respectively claim (if appropriate) a Medicare Benefit from the Commonwealth Government or payment from the Pharmacy Programs Administrator;  


MedReview Services may refer you a patient who does not satisfy the eligibility criteria for claiming a payment from the Commonwealth Government; 


It is your responsibility to confirm the eligibility of any patient to participate in a DMMR or RMMR; 


It is your responsibility to contact the referring medical practitioner and liaise with them in order to fulfil the requirements of a DMMR or RMMR; 


MedReview Services may refer you a patient who is not located within the same suburb or postcode as you; and 


MedReview Services will not assist you to make a claim for payment from the Pharmacy Programs Administrator, nor does MedReview Services make any representation or warranty about your eligibility to claim such a payment as a consequence of using MedReview Services's services. 


You may refuse to accept a referral provided you notify MedReview Services within 48 hours of having received the referral, after which time you will be deemed to have accepted the referral.  


Where you have accepted a referral, you agreeing to contact the referring medical practitioner and patient and make arrangements to conduct the DMMR or provide other clinically relevant services where a DMMR is not suitable.  


Where you complete a DMMR or RMMR, you will provide MedReview Services with a completed medication management plan for the patient, preferably using MedReview Servicess template which has been provided to you. 

 


On completion of a referral, you become liable to pay MedReview Services for its services  


MedReview Services will invoice you for its services after receiving a copy of the completed medication management plan for the patient.  


Where applicable, you will comply with the HMR Program Rules or RMMR Program Rules as published and updated from time to time by the Pharmacy Programs Administrator. 


MedReview Services may, in its absolute discretion, cease referring you patients for any reason, including if you have failed to:  


contact a medical practitioner or patient within a reasonable time after accepting a referral;  


pay an invoice of MedReview Services; or  


provide MedReview Services with a completed medication management plan for a patient. 


MedReview Services shall notify you if it intends to no longer provide you with referrals. 


You acknowledge that on accepting a referral from MedReview Services you are responsible for the patient in the same manner as if you had received a referral directly from a medical practitioner.  


Intellectual Property 


All material on the Website, including the text, code, information, graphics, illustrations, photographs, video, music, sound, trading names, service marks, logos, design, layout, downloads, pricing, products and services (Content) is owned by or licensed to MedReview Services. 


You must not reproduce, transmit, adapt, distribute, sell, modify, publish or store Content for any purpose, other than with the prior written consent of MedReview Services, or as permitted by law. All rights of MedReview Services are reserved. 


Trade marks used on the Website to describe third parties and their products are trade marks of those third parties and you are not permitted to use them without the consent of those third parties. 


Links and Third Party Content 


You must not link to, frame or mirror any part of the Website without MedReview Services’s written authorisation. 


The Website may contain links to or display the content of third parties (Third Party Content), including links to websites operated by other organisations and individuals (Third Party Websites).  Third Party Content and Third Party Websites are not under the control of MedReview Services.  MedReview Services does not endorse, approve or make any warranty or claim regarding Third Party Content, Third Party Websites or the products, services or information available on any Third Party Website, or in respect of the owner or operator of a Third Party Website or their conduct.  If you use or rely upon Third Party Content or Third Party Websites, you do so solely at your own risk. 


Your conduct 


You must not: 


use the Website in breach of any applicable laws or regulations; 


use the Website for commercial purposes (including for competitive advantage or to the competitive disadvantage of MedReview Services) other than as set out in these Terms and Conditions; 


use the Website to harm, abuse, harass, stalk, threaten or otherwise offend others; 


interfere with, disrupt, or create an undue burden on the Website; 


upload, post, transmit or otherwise make available any material that: 


is not your original work, or which may infringe the intellectual property or other rights of another person; 


is, or could reasonably be expected to be, defamatory, obscene, offensive, threatening, abusive, pornographic, vulgar, profane, indecent or otherwise unlawful, including material that racially or religiously vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability; 


includes an image or personal information of another person unless you have their consent; 


you know or suspect, or should reasonably know or suspect, to be false, misleading or deceptive; or 


contains large amounts of untargeted, unwanted or repetitive content. 


Without limiting the above, you will not and will not permit a third party to: 


misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technically harmful.  You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website.  You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack; 


use any method or process (including data scraping, web-bots, collection or accumulation tool, robot, spider or scripted responses) for the purpose of obtaining, processing, copying, replicating, distributing, reconfiguring, republishing, viewing, assessing, analysing, modifying or repacking the Content;  


use, obtain, or attempt to obtain from the Website, information in order to identify or discover pricing, underwriting, rating and related business methodology or systems; and

MedReview Services reserves the right to block or suspend any user of its Website, and to modify or remove any material uploaded, posted, transmitted or otherwise made available on the Website by any user, without notice.   

MedReview Services is not responsible for, and accepts no liability with respect to any material uploaded, posted, transmitted or otherwise made available on the Website by any person other than MedReview Services.  MedReview Services does not endorse any opinion, view, advice or statement made by any person other than MedReview Services. 

You agree to indemnify MedReview Services and each of the officers, employees, agents, contractors, suppliers and licensors (collectively Affiliates) of MedReview Services in respect of any liability, loss or damages (including all legal and other costs on a full indemnity basis) suffered or incurred by them arising (in whole or part) out of or in connection with the breach of or failure to comply with these Terms and Conditions, or any other default or wrongful conduct in relation to the subject matter of these Terms and Conditions, on the part of you or any of your Affiliates. 

Disclaimer and Liability 

MedReview Services does not guarantee that the Website will be secure or free from bugs or viruses or function without interruption or errors.  The Website is provided on an "as is" and "as available" basis.  You are responsible for configuring your information technology, computer programmes and platform to access the Website.  You should use your own virus protection software.  By accessing the Website, you assume all risks associated with its use, including but not limited to the risk that your computer, software or data may be damaged by any virus transmitted by the Website or by any Third Party Content or Third Party Website. 

To the extent permitted by law, MedReview Services and its Affiliates excludes all warranties, conditions and representations (whether express or implied) that may apply to the Website or any Content on it.  MedReview Services and its Affiliates will not be liable to you for any loss or damage of any kind, whether in contract, tort (including negligence), even if foreseeable, arising under or in connection with: 

your use of, or inability to use the Website; or 

your use of or reliance on any Content or material displayed on the Website, 

including any direct, indirect, special, incidental, consequential or punitive damages, which includes, but is not limited to, loss of revenue or profits or business or anticipated savings, loss of use or goodwill or reputation, loss of data, even if such loss was foreseeable.
